A good contract is how this business manages the risks associated with doing this kind of work. During the session, the participants will become more familiar with some contract basics. The class will also present an overview of some common contract terms and contract language. Conflict management and negotiation skills are also an important part of resolving issues in the industry. We will review the five conflict modes and learn some basic negotiation techniques to help you be more successful when a disagreement occurs. Finally, we will look at the financial impact that change orders have on cash flow and how to become more effective in managing changes when they occur. 2023 Convention Program &Auction Catalog 12 51st Annual Prayer Breakfast 8 - 9:30 am Pompeii Ballroom The Prayer Breakfast is a longtime PCCA tradition that unites members and their families in scripture, music, and fellowship. Our speaker Eric Isaac has served as the lead pastor of Neighborhood Church since its launch in 2018. Neighborhood Church is a financially transparent, missionally focused church that meets at Lincoln’s Beard Brewery in Miami. From its first day of existence, Neighborhood Church has given half of every dollar collected to individuals and families in need. The vehicle for this charitable giving is not third-party organizations or internet platforms like Go-Fund-Me. Instead, church members identify needs in their vocational, social, and neighborhood spaces in order to share the gospel and be a positive Christian presence in the community. Eric chose to be a bi-vocational pastor in order to launch a church that did not start in dependence or any form of financial debt. As a professor of religious studies at Florida International University, Eric also has a wonderful opportunity to minister to students on campus and has seen students become believers and be baptized. In addition to teaching and designing courses there, Eric also researches spiritual abuse within Christianity. He has collected one of the largest data sets in existence and is defending his research findings in April. Eric has been married to his wife Julie for 10 years and was born and raised in Miami. He holds a bachelor’s in Anthropology and Sociology from Florida International University, a master’s in theology from Fuller Theological Seminary, and a master’s in Latin American Studies from Florida International University. Maria Elvira Salazar (R-Fla.) introduced the long-awaited Dignity Act, a complete immigration reform bill consisting of three core principles: stopping illegal immigration, providing a dignified solution for immigrants living in America, and strengthening the American workforce and economy. The PCCA Government & Industry Affairs Committee believes this bill could help ease our industry’s dire worker shortage. PCCA has invited Rep. Salazar to our convention to discuss immigration reform with our members and to explain how the Dignity Act provides a “complete” solution to a problem that professional politicians have long ignored. PCCA Golf Tournament 12:15 - 6:30 pm Departs from Lobby Originally opened in 1923 as the Bayshore Golf Course, the Miami Beach Golf Club was given an $11 million face-lift and reopened in 2002. The result is a championship layout masterfully designed by world-renowned architect Arthur Hills. The course sits quietly nestled between the Atlantic Ocean and Biscayne Bay. The course has a colorful history. It was originally built by pioneering developer Carl Fisher to lure wealthy winter residents from up north. All our education programs, workforce development and government relations efforts, and damage prevention initiatives are sustained by your generous donations to the Auction and the bids we receive on Sunday. Important Education Activities The Auction has been bankrolling PCCA’s education programs for years, first the Young Construction Professionals and now the Leadership Development Program (LDP), the PCCA Scholarship Program, educational speakers at our meetings, and the Who Will Do the Work? program, which develops and implements utility construction curriculums at technical schools and community colleges. We are currently working with State Technical College of Missouri, Terra State Community College (Ohio), Wisconsin Indianhead Technical College, Monroe County Community College (Mich.), and Somerset Community College (Ky.). PCCA facilitates meetings with representatives from the schools, where they share their experiences and learn from each other’s successes and failures. PCCA awards four $10,000 scholarships each year to the children and other dependents of PCCA members’ employees as well as the newly created $1,000 “Who Will Do the Work?” Scholarship for students at PCCA-affiliated schools. Recipients of PCCA’s 2022-2023 scholarships were Eli Herkenrath, Silver Lake, Kans.; Brady Harmand, Marland, Okla.; Benjamin Tholen, Bristol, Ill.; and Richard Sapp, Coleman, Mich. The “Who Will Do the Work?” scholarship recipient Bret Jennings, Linn, Mo., who is in the Utility Systems Technician program at the State Technical College of Missouri. Workforce Development PCCA has been addressing the industry’s shortage of workers in a variety of ways over the years. Of course, there is the program with technical schools and community colleges and the scholarship program, and PCCA also works with the Wireless Infrastructure Association under a U.S. Department of Labor grant designed to support large-scale expansions of apprenticeship in the utility construction industry. PCCA has also been looking at immigration reform as a way to build up the construction workforce. As PCCA Chairman Jerrod Henschel, Equix, Inc., said: “Lack of labor is holding back economic growth. Meanwhile, there are millions of really good, hard-working people trying to enter this country that want an opportunity at the American dream. What’s been happening at the Mexican border is a travesty. We need a balanced approach, control the border to prevent trafficking and all forms of illegal activity, while at the same time instituting real immigration reform that allows good, hard working people a legal way to enter the country, become taxpayers, and pursue their dreams.” As PCCA pursues the daunting task of immigration reform, the association has found a starting point and perhaps a legislator to champion the cause. Last year, Rep. Maria Salazar (R-Fla.) and six of her Republican House colleagues introduced the Dignity Act, a complete immigration reform bill consisting of three core principles: stopping illegal immigration, providing a dignified solution for immigrants living in America, and strengthening the American workforce and economy. PCCA’s Government Affairs Committee is intrigued by the Dignity Act proposal and is excited that Rep. Salazar has accepted their invitation to join us here in Miami this week to discuss immigration reform with our members. Damage Prevention PCCA is sharply focused on the safety of its workers, the public, and all underground facilities, and Auction proceeds will help fund our damage prevention work. In 2021, PCCA was the driving force behind an independent study to exhaustively examine 811 operations in every state, see what is working and what is not, estimate costs and waste, and provide recommendations for improvement. The “811 Emergency” study found that “failures in the nation’s 811 system used to prevent damage to underground utility lines are costing $61 billion a year in waste and excess costs and creating unnecessary hazards for public safety, particularly in states where the implementation and accountability are most lax.” The study was released in November 2021 to considerable attention, and much work was done in 2022 to update reports and to get states to consider and adopt the study’s recommendations. That work is ongoing. A top priority for PCCA is ensuring accurate mapping of underground facilities, and the association believes that electronic Geographic Information System mapping should be required by facility operators and that the Common Ground Alliance should develop a tool to access this data. “This is the single most meaningful thing that could be implemented to improve damage prevention” Henschel said. “We have the technology, and now we have to get all the utilities on board.” Infrastructure Funding with Conditions In recent years, PCCA has greatly expanded its government relations efforts, aiming to ensure that our voice is heard on issues important to our members and to establish PCCA as a resource for lawmakers and regulators in advance of government actions. Auction proceeds help fund these efforts. While PCCA supported passage of the federal infrastructure law—the Infrastructure Investment and Jobs Act—at the end of 2021, the association remains watchful of how the law is implemented and what requirements are attached to it by the Biden administration. The IIJA represents the largestever investment in broadband infrastructure, but the funding presents some challenges as well, including unrealistic Buy American requirements, mandatory or highly encouraged project labor agreements, and continuing workforce issues. PCCA also opposes a new Environmental Protection Agency rule, Revised Definition of Waters of the United States, released in December and supports a joint resolution of disapproval under the Congressional Review Act, which was introduced in February.
